Please read these Terms and Conditions carefully before using Our Service. Interpretation and Definitions  The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or plural.
  For the purposes of these Terms and Conditions:

  ✓ Application means the software program provided by the Company downloaded by You on any electronic Device, specifically games developed by Kocow Games.

  ✓ Application Store means the digital distribution Service operated and developed by Apple Inc. (Apple App Store) or Google LLC. (Google Play Store) in which the Application has been downloaded.

  ✓ Country referred to: South Korea

  ✓ Company (also referred to as "the Company", "We", "Us" or "Our" in this agreement) refers to Kocow Games.

  ✓ Device means any device that can access the Service such as a computer, a cellphone, or a digital tablet.

  ✓ Service refers to the Application and other services We control.

  ✓ Terms and Conditions (also referred to as "Terms of Use" or simply "Terms") mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service.

  ✓ Third-Party Social Media Service means any services or content (including data, information, products, or services) provided by a third-party that may be displayed, included, or made available by the Service.

  ✓ You means the individual accessing or using the Service, or the Company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Acknowledgment  These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and the Company. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service. Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users, and others who access or use the Service. By accessing or using the Service You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions then You may not access the Service. You represent that You are over the age of 5. The Company does not permit those under 5 to use the Service.
  Your access to and use of the Service is also conditioned upon Your compliance with any game-related regulations set by Your country for individuals over the age of 5. If Your country has specific laws regarding the age of consent for game usage, You must adhere to those laws. Ownership of In-Game Assets  Ownership of in-game assets and copyright is determined based on the following:

  ✓ Virtual Goods and Currency: All virtual goods, including but not limited to characters, items, and in-game currency ("Virtual Goods"), that You may obtain or purchase within the Application are owned by Kocow Games. They do not have any monetary value and cannot be exchanged for real money or for any goods or services.

  ✓ No Property Rights: You acknowledge and agree that these Virtual Goods are accumulated as part of Your account and therefore You shall have no ownership or property interest in any of those Virtual Goods. Your purchase of Virtual Goods only provides You with a limited, non-transferable, revocable license to use those Virtual Goods within the Service. In the event of game or Service termination, or if a user's account is banned or suspended, the license of any virtual goods associated with that account will automatically be transferred to Kocow Games. 

  ✓ No Resale or Transfer: You agree that You will not sell, transfer, trade, auction, or buy or accept any offer to sell, transfer, trade, or auction, any content within the Service, including without limitation, any Virtual Goods, to any other user or third party without the express written consent of Kocow Games.

  ✓ Copyright of Game Assets: While the in-game rights of any virtual goods or assets belong to Kocow Games, the intellectual property, including copyright, of specific game assets (such as art, design, and sounds) remain vested in the individual or entity that created them. You acknowledge that by using the game, You are not granted any rights to the intellectual property of these assets, only the right to use them within the confines of the game.

Service Monetization   The Service may include in-app purchases that allow You to buy products, Services, or other forms of content. In-app purchases may be made with real money. Please ensure that You read the Terms and Conditions and confirm the price before making any in-app purchases. We are not responsible for any unauthorized in-app purchases. All in-app purchase processes are exclusively handled by the Application Store. Kocow Games does not manage or interfere with these transactions.
  Our Service may also include advertisements. The type and amount of advertising in the Service are subject to change. In exchange for providing the Service for free or at a reduced cost, You agree to accept Our presentation of these advertisements. If You do not wish to see these advertisements, You may choose to purchase an ads removal product, if available. All ads removal products do not include rewarded ads removal. Service Refund  Consumable products are non-refundable in principle, while non-consumable products are eligible for refunds within 5 days of purchase. Consumable products include in-app currencies and package items, while non-consumable products include ads removal products and premium subscriptions. Service Availability  We strive to provide the best experience possible; however, We cannot guarantee that Our Service will always function without disruptions, delays, or imperfections. The Service is provided based on its availability and current functionality. We might occasionally need to repair bugs, install updates, or do maintenance work which might affect accessibility. We reserve the right to modify or discontinue, temporarily or permanently, functions and features of the Service, all without liability to You for any interruption, modification, or discontinuation. Limitation of Liability  To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of these Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.
  Some states do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply. In these states, each party's liability will be limited to the greatest extent permitted by law. Links to Other Websites  Our Services may contain links to third-party websites that are based on Third-Party Social Media Service or affiliate services that We do not own or control. The Company has no control over and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such web sites or services.
  While We advise You to read the terms and conditions and privacy policies of any third-party websites or services that You visit, it is entirely at Your discretion. The Company will not be held responsible for any repercussions arising from Your decision not to review such third-party terms or policies. You are advised to exercise caution when navigating to third-party websites. Kocow Games is not responsible for the content or activities of these external sites. Governing Law  The laws of the Country, excluding its conflicts of law rules, shall govern these Terms and your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws. It's important to note that there might be different laws applicable based on the country of usage; You should verify and comply with those laws where necessary. All legal procedures related to this Service shall be conducted in accordance with the laws of the respective country. For European Union (EU) Users  In accordance with the General Data Protection Regulation (GDPR), EU users have the right to access, rectify, and delete their personal data collected by the Service. Additionally, EU users have the right to object to the processing of their data and the right to data portability. Please be aware that violations of the rights provided by the GDPR may result in legal penalties. United States Legal Compliance  You represent and warrant that (i) You are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a "terrorist supporting" country, and (ii) You are not listed on any United States government list of prohibited or restricted parties. Severability and Waiver  If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect. Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party's ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach. Disputes Resolution  If You have any concerns or disputes about the Service, You agree to first try to resolve the dispute informally by contacting the Company. Termination  We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions. Upon termination, Your right to use the Service will cease immediately. Translation Interpretation  These Terms and Conditions may have been translated if We have made them available to You on Our Service. You agree that the original English text shall prevail in the case of a dispute. Changes to These Terms of Use  We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days' notice prior to any new Terms taking effect. What constitutes a material change will be determined at Our sole discretion.
